Claim and Counter Claim
It is now universally recognized that economic growth and development have to b guided by the compulsion of sustainability, as we do not have the luxury of ignoring the economic and environmental threat that a fast depleting ecosystem posses not only to India but to entire world. Recent study published in science daily claiming temperature of pacific ocean affect tornado activity in u.s, is a specific example proving no one is immune from the challenges of climate change ,ecological degradation, ozone layer depletion and so on. But at the same time pursuit of rapid growth is imperative to developing countries such as ours to uplift millions from poverty, illiteracy.
Environment and socio-economic development are so interlinked that development can not be sustainable without considering the environmental dimension in it. It is there fore , crucial that we find the fine balance between environmental conservation and economic growth. The importance of sustainable development was reaffirmed by the world leader at UNCCC Rio+20 summit. In any endeavor, which involve creation of fine line between to set of parameter, disputes are bound to arise based on claims and counter claims of different stake holder with varied interest.
It in this context the role of NGT marks its prominence as an effective and efficient adjudicator ,to maintain the precarious balance between development and sustainable development, and providing justice in environment related issues. We are now witnessing lively, debates between the supporters of development who have been crying over the paralysis of execution of many development projects due to environmental concern. On the other hand we have equally legitimate concern raised by environmentalist who have brought to light the irreparable damage caused to our ecosystem due to human greed.
In such matter both group have legitimate claims and arguments and are correct in their view and perception.The challenge is to find a common ground and pave the right way forward. In such situation role of NGT gets magnified to many folds ,and will have to play a role of facilitator , inspired by principle of natural justice. On this foundation day of NGT it is worth reminding that it got its commendable beginning but it is also advisable that it must also maintain the fine balance of judiciary and executive and must not fall in the foul play between caesar's wife and caesar itself.
